Podstawa Prawna:
ENEFI Energy Efficiency Plc. (“Company”) hereby informs its Honourable Investors in relation with

the lawsuit proceedings in Romania about the following:

1. The Harghita County Tribunal accepted the resignation of the Court of Registration from the

application for the liquidation of Faapritek SA in its decision made in document No: 837/996/2017 as

a result of which the company shall remain active and no liquidation proceedings shall be initiated

against it.

2. The Court rejected the appeal of the Town of Gheorgheni in the lawsuit against the Harghita County

Prefect and confirmed the first instance decision according to which the two decisions of the

municipality made retrospectively in relation with the price of distant heating shall be void.

As the Company had previously announced the Town of Gheorgheni made two decisions on

28/10/2016. In one decision it is retrospectively stated that the Town had voted for the price increase

of district heating on its regular meeting held on 19/03/2015 and amends the decision under which the

date of entry into force shall be the day of making the decision (according to their view), i.e.

19/03/2015. Payment of the district heating price difference for the period between 01/04/2015 and

01/03/2016 has also been approved from the local budget. The other decision approves the local

district heating price. The Town intended to make the legal grounds for the previous termination of

CDR impossible. In addition to CDR, the Town Clerk also made remarks on the decisions and the

Prefect filed proceedings.

The above decision amongst others is significant because the court had previously suspended the

actual hearings of the lawsuit for the compensation of damages until the closure of the above

proceedings so the constraints against the hearings thereof have been eliminated.
